H-1B Cap Season for FY 2025 is here!

Hear ye! Hear ye! H-1B Cap Season is BACK!!

Employers, if you have not done so already, NOW is the time to begin evaluating your H-1B needs for FY 2025.

The United States Citizenship and Immigration Services (USCIS) will soon release dates and deadlines for the H-1B cap registration process, and we anticipate that the registration itself will begin in March 2024.

In 2020, USCIS implemented a system which requires petitioners (employers) to electronically register with USCIS and pay a $10 nonrefundable fee for each H-1B registration. Then the random selection (a/k/a the “H1B Lottery”) begins. Those who are selected will be invited to submit an application.

March will be here before you know it, so it is important to prepare ahead of time. Here is what employers can do RIGHT NOW:

  1. Have potential employees gather their foreign degrees, request required transcripts, and begin preparing experience letters (if necessary).
  2. Develop your detailed job descriptions.
  3. Begin gathering your supporting documents.

There is an extremely high demand for the H-1B visa and there is a cap (limit) on the number of visas that are issued each year. There are also very strict deadlines that must be met, which is why it is so important to be prepared ahead of time.

Important Dates have not yet been posted for the 2024 CAP Season, but the following dates are what we expect for this year, based on last year’s dates. (Subject to change upon official announcement.)

Feb 22, 2023: Petitioners and Registrants can begin creating H-1B registrant accounts.

March 1, 2023: H-1B registration period opens.

March 18, 2023: H-1B registration period closes

March 31, 2023: Date by which USCIS intends to notify selected registrants.
