On September 10, 2021, DHS published a Federal Register Notice (FRN) announcing that beneficiaries under the TPS designations for El Salvador, Haiti, Honduras, Nepal, Nicaragua, and Sudan will retain their TPS, provided that their TPS is not withdrawn because of individual ineligibility.

A preliminary injunction was issued by the U.S. Court of Appeals for the Ninth Circuit in Ramos et al. v. Wolf et al., on September 14, 2021 which prohibited DHS from terminating TPS for these countries. In compliance with this injunction, DHS automatically extended the validity of Employment Authorization Documents (EADs) and other TPS-related documentation for TPS beneficiaries affected by the injunction through December 31, 2022.

There have also been extensions of the registration periods by from 180 days to 18 months for initial (new) applicants under the TPS designations for Venezuela (through September 9, 2022), Syria (through September 30, 2022), and Burma (through November 25, 2022).

TPS applicants who are eligible nationals of Burma, Somalia, Syria, Venezuela or Yemen, or individuals without nationality who last habitually resided in those countries, can now file Form I-821, Application for Temporary Protected Status, online, if they are applying for TPS for the first time. This application may be filed as a standalone form or concurrently with Form I-765, Application for Employment Authorization.

El 10 de Septiembre del 2021, DHS publicó un Aviso de Registro Federal anunciando que los beneficiarios bajo las designaciones TPS para El Salvador, Haití, Honduras, Nepal, Nicaragua y Sudán reteneran su TPS, con tal que su TPS no sea retirado por inelegibilidad individual.

Un mandato preliminar fue publicado por la Corte de Apelaciones de Estados Unidos para el Noveno Circuito en Ramos et al. v. Wolf et. al., el 14 de Septiembre del 2021 que prohíbe a DHS terminar TPS para estos países. En cumplimiento con este mandato, DHS automáticamente extendió la validez de los Documentos de Autorización de Empleo (EADs) y otra documentación relacionada al TPS para los beneficiarios del TPS que sean afectados por el mandato hasta diciembre 31, 2022.

También han habido extensiones a los periodos de registro, pasando de 180 días a 18 meses para aplicantes iniciales (nuevos) bajo las designaciones del TPS para Venezuela (hasta el 9 de Septiembre del 2022), Syria (hasta el 30 de Septiembre del 2022), y Burma (hasta el 25 de Noviembre del 2022).

Applicants al TPS que son nacionales elegibles de Burma, Somalia, Siria, Venezuela o Yemen, o individuos sin nacionalidad que su última residencia habitual a sido en uno de estos países, ahora puede presentar Form I-821, Aplicación para Estatus de Protección Temporal, en línea, si están aplicando para TPS por primera vez. Esta aplicación puede ser presentada de forma independiente o junto con el Form I-765, Aplicación para Autorización de Empleo.
