Grounds for Deportation from the United States

Whether a person is arrested or is under an investigation by the Department of Homeland Security (DHS), Immigration and Customs Enforcement (ICE) will send out a “Notice to Appear” (NTA), which contains the date of a scheduled removal proceeding. An immigration judge presides the hearing, listening to arguments made from the U.S. Citizenship and Immigration Services (USCIS) representatives and the immigrant’s lawyer. The judge will then decide if the immigrant will be removed from the country or obtain relief from removal.

The following are the most common grounds for deportation in the U.S.:

  • Being convicted of a criminal offense (e.g. crimes of “moral turpitude,” aggravated felonies, drug crimes, domestic violence offenses, and gun crimes).
  • Illegally entering the United States
  • Violating the conditions of their visa or work permit
  • Becoming a public charge within five years of entering the country
  • Denial of asylum applications
  • Being a part of a prohibited organization

Our firm can determine whether the charges against you are correct and argue that you are facing false charges, argue you qualify for asylum, help you obtain a green card, file an application for cancellation of removal on your behalf, or request prosecutorial discretion based on having good moral character.
