How to File a Family-Based Immigrant Visa

A U.S. citizen or LPR must be at least 21 years of age to file a petition on behalf of a family member to come to the U.S. and become a permanent resident. There are two types of family-based immigrant visas: immediate relative visas and family preference visas.

Immediate relative visas are based on close relationships with a U.S. citizen. In other words, a U.S. citizen can file a petition for their spouse, unmarried child (under 21 years old), or parent. There is no timeline for these types of family visas.

Family preference visas are for more distant family relationships with a U.S. citizen and some specified relationships with an LPR, such as married children and siblings. Keep in mind, only U.S. citizens may file a petition for their brothers and sisters and their married children. Family preference visas are limited each fiscal year.

The sponsor relative must file a Petition for Alien Relative (Form I-130) with USCIS. Additionally, they can also file it with the Application to Register Permanent Residence or Adjust Status (Form I-485).
